Motorbike Rental Terms and Conditions:

Motorcycles and accessories must be personally collected from and returned to our premises in Cape Town by the renter and during normal trading hours. Although we do try to accommodate all renters requests as much as reasonably possible, different models are subject to availability. We do reserve the right to replace the confirmed model with a similar Motorbike if deemed necessary. Off-road use of our Harley-Davidson rental motorcycles is not allowed and/or insured. Therefore renter is liable for full settlement of any damage that may occur as a result of off-road use to the rented motorcycle. Renter must have held a full Big Bike License (Class A) for at least 1 year. License must at least be valid until the day of return of the rental motorcycle. Renter must be at least 21 years of age, over 1.65 m in length and have full physical ability. Renter is liable for maximum ZAR 15.000 damage excess per incident, as well as for any fines related to traffic misbehavior. The insurance excess liability cannot be wavered and must be paid as a deposit by credit card on collection of the motorcycle. The insurance excess liability will be refunded on return of the motorcycle in undamaged condition. Therefore a walk-around inspection will be carried out with the renter on collection and return of the motorcycle. Only reception of the non-refundable deposit of 30% of the total rental fees confirms a booking. Until a deposit has been received by Cape Bike Travel, a booking is not regarded as confirmed, but merely as an option. Options are valid for 10 days (incl.weekends), thereafter automatically expires. EFT, Visa and Mastercard are accepted for payments and deposits. Prices can be subject to change without prior notice, unless deposit has been paid, in which case the rate is fixed.

Responsibility and Prices:

Items included in the tour price are stipulated in the respective tour itinerary and form part of this contract. All items not mentioned as included are to the clients own expense. Written quotations will be provided on request for any services not included in the tour price. Maps and other general Information do not form part of the contract.

CBT is responsible for providing the services listed in the tour description according to the local standard and the accurate description of services offered in its literature. CBT is responsible for conscientious travel preparations and will carefully select and constantly check our contractors, such as accommodation establishments and rental agencies. CBT is not responsible or liable for any accidents or damage as a result of negligence, either by us or a supplier of ours.

CBT reserves the right to change prices, routing and content of the tour. The extra cost if any resulting there from shall be paid for by the participant. We also reserve the right, without prior notice, to withdraw any part or all of a tour and to make such changes as may be necessary. Furthermore, it is agreed and understood that the owners, operators and agents of this tour including CBT are not the guardians of any participant’s safety and they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation, or the client’s participation in connection with the tour, which might result in injury, death or other damage to the client, his property or his family, heirs or assigns. CBT is not responsible or liable for a delay resulting from the manufacturer’s/agent’s failure to deliver the motorcycle on time and is not responsible for any delays or changes in schedules or other conditions. The participant further agrees to participate at his/her own risk.

Luggage:
CBT assumes no responsibility for loss, damage or delay in delivering luggage to tour participants. Luggage turned over to us for transport each day is done so at the participant’s own risk. Luggage insurance is recommended and participants are limited to two pieces of luggage per rider.

Non-observance of traffic laws and group travel regulations:

If any of the participants does not comply with traffic laws or the requirements for group travel, CBT has the right to cancel the individual’s tour, which means that his/her riding privileges will be suspended and the motorcycle secured. Participants are responsible for any traffic fines obtained as a result of any traffic violation.

Acceptance of Terms and Condition/Waiver and Release:

By booking with CBT the client expressly accepts the following declaration:
I am aware that motorcycling is a potentially dangerous and life-threatening activity. I herewith confirm that I am in the possession of a valid driving licence that entitles me to operate a Motorcycle with an engine capacity greater then 600ccm producing more than 30KW on South African roads. I have been briefed on how to safely operate the motorcycle and how to behave in South African traffic as well as on how to safely ride in a group. I will at all times adhere to the traffic laws and the rules of group travel and not endanger/damage any person or nature. I confirm that I am physically and mentally able to safely operate the motorcycle.

I agree that Cape Bike Travel CC, its officers, directors, employees and agents (hereinafter, the “RELEASED PARTIES”) shall not be liable or responsible for injury or damage to me or my property during any activities or events organised by Cape Bike Travel CC and resulting from acts or omissions occurring during the performance of the duties of the released parties, even where the damage is caused by negligence (except gross negligence or wilful intend) I understand and agree that all participants participate voluntary and at their own risk in all Cape Bike Travel activities and assume all risks arising out of the conduct of such activities. I release and hold the released parties harmless from any loss of property, any injuries or trauma including Death arising from me participating in the activities. I am solely responsible for any Damages arising to persons and/or property as a direct result from me operating the motorcycle insofar as they are not covered by the relevant Insurance.

I understand that the released parties may take photographs at the events for use in Cape Bike Travel related materials. I hereby confirm that I have no Objection that my photograph is taken and used in this context and for this purpose.

By signing the release and authorization to photograph, I certify that I have read this release and fully understand it and that I am not relying on any statements or representations made by the released parties. Should any clause in this document not be in accordance to current South African law it shall be amended to the closest interpretation possible in letter and spirit. The rest of this document shall not be affected.
